IMAGE USE AGREEMENT Terms and Conditions of Use
The images/slides (hereinafter being referred to as the 'product') provided by Shane Batham (hereinafter being referred to as 'the photographer') are supplied for a one time use only. This means if the product is used again by the renter/user (hereinafter being referred to as 'the client') he/she must pay an additional fee.
If the product is required for areuse in the same format as the original, any additional charges will be at the discretion of the photographer. The product can never be scanned from a brochure, poster, book, magazine article etc as this is a breach of copyright. The photographer reserves all rights to the products he provides.
If the client wants to use the same product for another purpose, then he or she must provide, in writing, the conditions of use required. The photographer will then give his approval subject to the conditions under which the client wishes to use the product, and the appropriate fee being paid.
The image/s cannot be stored electronically on any computer and the CD upon which the image/s was provided must be returned to Living Reef Pty Ltd at PO Box 1192 Airlie Beach QLD 4802 in due course.
In the instance where low resolution images are provided on CD for perusal prior to purchase, these images are not excluded from copyright and must be paid for prior to publication. Should any costs be incurred by Shane Batham Photography, eg burning images to CD, and no images selected for purchase, a nominal fee of $50.00 plus GST will be charged to cover costs and time.
